Although death by neurologic criteria is legally recognized throughout the United States, state laws and clinical practice vary concerning three key issues: the medical standards used to determine death by neurologic criteria, management of family objections before determination of death by neurologic criteria, and management of religious objections to declaration of death by neurologic criteria. The American Academy of Neurology and other medical stakeholder organizations involved in the determination of death by neurologic criteria have undertaken concerted action to address variation (...) in clinical practice in order to ensure the integrity of brain death determination. To complement this effort, state policymakers must revise legislation on the use of neurologic criteria to declare death. We review the legal history and current laws regarding neurologic criteria to declare death and offer proposed revisions to the Uniform Determination of Death Act and the rationale for these recommendations. The divine attributes of omniscience and omnipotence have faced objections to their very consistency. Such objections rely on reasoning parallel to semantic paradoxes such as the Liar or to set-theoretic paradoxes like Russell's paradox. With the advent of paraconsistent logics, dialetheism—the view that some contradictions are true—became a major player in the search for a solution to such paradoxes. The work of Isabelle Stengers engages a baffling number of topics and includes collaborators from across many disciplines and practices. For this reason, there is perhaps no set of terms or concepts that easily encapsulates her work. Nevertheless, in recent years concepts such as “cosmopolitics” and the “ecology of practices” have gained a special currency in the context of humanities and social science research. While cosmopolitics is not a new term, and Stengers is certainly not the only one to employ (...) it today, her use of it, and in conjunction with the ecology of practices, seems to have sparked the critical and speculative... Jason Stanley argues in his new book that propaganda is more prevalent within liberal democracies - and is of far greater concern - than is typically assumed. Indeed, Stanley suggests that the very idea that propaganda only proliferates within authoritarian regimes, which have ministries set aside for its production, is a central tenet of the propaganda of the West. Stanley's aim in this book is to outline the distinctive features of propaganda within a liberal democracy. On his account, the 'flawed (...) ideology' of vested and powerful interest groups undermines the genuinely valuable ideals at the heart of the democratic project; this is what he refers to as 'demagogic propaganda'. Although I am highly sceptical of the argumentative strategies Stanley employs, the book raises significant issues about the extent to which public debates in countries like the United States and Australia involve distorted conceptions of what democratic principles properly entail. Criticisms of the undemocratic and illiberal nature of political processes within liberal democracies are of course common on the left. Two key features set Stanley's work apart from much of that literature. First, he regards democratic principles as genuinely valuable and does not dismiss them as 'mere reactionary claptrap', as many in the New Left did forty years ago. Second, and more significantly, his intellectual background is highly unusual. Stanley is an analytic philosopher whose training was primarily in epistemology and formal semantics rather than in social theory or political philosophy. This is uncommon, since most analytic philosophers who are focused on epistemology and similar issues avoid political questions, a reticence of which Stanley does not approve. Indeed, the book is driven, as he says, by a profound sense of regret that analytic philosophy has surrendered many of its central questions to sociology and social theory. (shrink)

Recently, there has been a heavy debate in the US about the government’s use of data mining in its fight against terrorism. Privacy concerns in fact led the Congress to terminate the funding of TIA, a program for advanced information technology to be used in the combat of terrorism. The arguments put forward in this debate, more specifically those found in the main report and minority report by the TAPAC established by the Secretary of Defense to examine the TIA issue, (...) will be analysed to trace the deeper roots of this controversy. This analysis will in turn be used as a test case to examine the adequacy of the usual theoretical frameworks for these kinds of issues, in particular the notion of privacy. Whereas the dominant theoretical framing of the notion of privacy turns around access to information, most of the core arguments in the debate do not fit in this kind of framework. The basic disagreements in the controversy are not about mere access, they involve both access and use. Furthermore, whereas the issue of access by itself refers to a more or less static situation, the real disagreements much more concern the organisational dynamics of the use of information, the mechanisms in the organisation that control these dynamics, and the awareness present within the organisation of the ‘social risks’ these dynamics represent. The bottom line question is whether the assessment of these gives sufficient reason for trust. (shrink)

It has often been suggested that technology carries values and biases embedded in it. This paper is an examination of the relation between computer technology and the incorporation of values and biases. The social complexity of this issue tends to be underexposed. Suggestions are presented for a more comprehensive understanding.

The ‘beautiful axiom’ to which Dickens refers is a central feature of Thomas Hobbes' thinking but its precise role in his moral philosophy remains unclear. I shall here attempt both to dispel the unclarity and to evaluate the adequacy of the position that emerges. Given the high level of contemporary interest in Hobbes' thought, both within and beyond philosophical circles, this is an enterprise of considerable importance. None the less, my interest is not merely interpretative, since the assessment of Hobbes' (...) attitude to ‘the beautiful axiom’ raises important and difficult questions about what might be termed the preconditions of morality. Three remarks, which are sometimes made about Freud's distiction between Ego and Id are discussed: 1. This distinction would have no analogy in other psychological concepts. 2. The essence of the "I" would be misjudged here. 3. It would be the rest of an atomising psychology, not yet arriving at the modern views of totality. Although the common parlance concerning psychic "parts" has indeed analogies in the old atomistic-psychological conceptions, these instances, as well as the conflicting drives are and have (...) been always considered in psychoanalysis as expressions of which the person himself is the subject. Especially the concept "Id" must be looked at as equivalent to the biological total, to the concept: Person-Stern. The concept I or Ego, as a special structure of "figure" within this whole, means no split-off part, but is equivalent to what is called elsewhere "durchstrukturiertes Unterganze". Freud entitles a certain intern organisation with the word "Ich". He that thinks the essence of "the" I herewith misjudged, confuses word and concept -- the word I contains a lot of equivocations. That there are conflicts within the person is a basic matter of fact, which is not to be pushed aside in favour of totalitarian dogmatics, this conflict must be expressed in our terminology in some way or other. Terms, by way of comparison borrowed from material situations cannot always be avoided, and need not give any inconvenience, provided reflecting over the import of the terms is practised sufficiently.
